Section 1.
The Library having heretofore elected to be covered by the New York City Career and Salary Plan and such election having been approved by the Board of Estimate on April 21, 1955, the wages and other economic benefits of employees shall be in accordance with the applicable New York City Labor Relations Orders and any underlying collective bargaining agreements as set out in Article XV below and the attached Schedule A.
Section 2.
The parties recognize that to provide and maintain adequate service to the public on a year round basis, the Library must always be adequately staffed. In the establishment of vacation schedules, the Library shall have sole right to determine staffing needs. Accordingly. annual leave shall be scheduled by the Library consistent with overall staffing needs, in each agency, based on the choice of those employees with the greatest system-wide seniority in classification. Selection shall be made in descending order within each classification series, e.g. Principal Librarian, Supervising Librarian, Senior Librarian II, Senior Librarian, Librarian, Librarian Trainee.
Section 3.
There shall be no restriction regarding the scheduling of accrued annual leave except that it be consistent with the provision of service to the public. An employee shall be allowed to carryover up to five (5) days of unused annual leave to the following year. The balance of the employee's annual leave shall be scheduled pursuant to the Employer's existing leave policy.
Section 4.
(A) Employees in the titles of Motor Vehicle Operator, Maintainer, and ITS Technicians working outside the central building shall have a 1/2 hour lunch period.
(B) Employees in the titles of Custodial Assistant, junior Library Custodian and Assistant Library Custodian shall have a 1/2 hour lunch period. In the event that a return to a one hour lunch period is proposed, the parties shall, upon the request of the Union, reopen negotiations on this matter.
Section 5.
Assistant Library Maintainers and Library Maintainers assigned to the Mechanical Division shall be permitted choice of work shift and/or assignment on the basis of seniority in title, whenever a vacancy in such work shift and/or assignment occurs.
Section 6.
An employee on leave for jury duty shall be assigned to a steady week-day shift while on such leave. Any rescheduling of other employees to provide coverage for employees on jury duty shall not constitute an avoidance of overtime.
Section 7.
Employees in the Engineering/Facilities Planning Department shall be given 15 working days notice of any major change in their fixed shifts or weekend schedules except if such change is for the purpose of covering vacations, illness, or other unforeseen contingency.
Section 8.
Holidays and overtime work, excluding Sundays, shall be scheduled on a rotating basis for all employees. Employees in the same title and with similar qualifications shall be permitted to trade holiday or overtime work between themselves, subject to the approval of the Library. Such approval shall not be withheld except for health and safety consideration.
Section 9.
Work schedules shall be posted one month in advance in each agency. Where feasible, employees shall be given 48 hours notice of changes in their work schedules.
Section 10.
Whenever the Library determines that shift changes are to be made, it shall first attempt to make such changes among volunteers, in order of seniority. In the event that there are no, or an insufficient number of volunteers, such shift changes shall be made on the basis of inverse order of seniority. Employees on their introductory period shall be excluded from any calculation of inverse order of seniority.
Section 11.
One employee in the maintainer classification at the Central Library on the 6:00 a.m. to 2*00 p.m. shift and one such employee on the 1:30 p.m. to 9:30 p.m. shift or on such other comparable shifts as may be established by the Library shall be designated as assigned to the boiler at the Central Library building. Because of the nature of such duty such employees shall work a straight eight hour shift without any lunch or other meal period. Such employees, however shall be permitted to eat their lunches while in attendance at the boiler room.
Section 12.
Whenever the Library determines that Sunday service at the Central Library may be staffed by volunteers from among staff normally assigned to branches, it shall offer such work on a rotating basis.
Section 13.
In agencies not having regularly scheduled Saturday service, whenever a regularly scheduled holiday leave day falls on a Saturday, the Library, at its sole option, may provide an alternate leave day during either the week immediately preceding or the week immediately following such holiday, or may add a day to the employee's leave balance. Employee requests to have either the Friday immediately preceding such holiday or on the Monday immediately following it shall be handled on an exception basis and may be granted by the agency mangers in their discretion consistent with the needs of the agency.
Section 14.
The Lincoln's Birthday and Election Day holidays shall be scheduled as floating holidays. The Library shall remain open for service on these holidays. Employees who are in active pay status on the day before the holiday shall receive the floating holiday and shall have one year in which to use the respective holiday.
Section 15.
Approved sick leave and annual leave used for other than vacation purposes may be used in units of one-half hour or more. Where more than one-half hour's leave time is used, the actual amount so used will be charged.
Section 16.
Effective May 1, 1997 and on each succeeding May 1, all employees who are in pay status and who are covered by the provisions of this agreement shall receive a bonus day to be added to the employee's annual leave balance.
