AGREEMENT WITH LOCAL 1321

 

ARTICLE X - UNION RIGHTS AND RESPONSIBILITIES

 

Section 1.

The parties agree that they will not interfere with the right of any employee to become a member of the Union if he/she desires, or to refrain from Union membership, and the parties shall not discriminate against any employee because of his/her membership or non-membership in the Union.

Section 2.

Nothing in this agreement shall be construed as requiring an employee to join the Union. The right of an employee who has joined to withdraw from the Union and the right of an employee to refrain from joining the Union is recognized by the parties to this agreement.

Section 3.

Nothing in this Agreement shall be construed to preclude or restrict the right of any individual employee to discuss with the Library or the right of the Library to discuss with any individual employee, any matter relating to the terms and conditions of his/her employment, except that as to matters which are the proper subjects of collective bargaining, any changes or modifications shall be made only through negotiations with the Union.

Section 4.

The Library shall provide the Union with the name and work location of a new employee whose position falls within the bargaining unit, within two (2) weeks following the end of the month in which the employee was hired.

Section 5. Bulletin Board.

(A) At each agency where there are employees covered by this Agreement, the Library shall furnish space on an existing staff bulletin board, twenty (20) by twenty-eight (28) inches in size, but in no event shall this space exceed one-half of the existing staff bulletin board, for use by the Union.

(B) The Bulletin Board shall be used only for notices of legitimate Union business, such as:

(1) Recreational and social affairs of the Union (2) Union meetings (3) Union Elections

(C) Any other notices may be posted only with the Library's prior approval. Notices and announcements shall not contain anything of a public political nature, or anything reflecting unfavorably upon the Library or any of its employees. No material, notices or announcements which violate the provisions of this section shall be posted. No materials abusive of the Library or its employees shall be posted by the Union.

Section 6. Designation of Union Officers and Stewards.

The Union shall certify in writing to the Employer the names of its officers and stewards and any changes in such Union representatives as such changes occur during the term of this Agreement.

Section 7. Union Activity on Employer Time and/or Premises.

The Union agrees that working hours shall be considered productive hours and that there shall be no Union work or Union activity on Library time and/or premises other than that specifically permitted by the express terms of this Agreement.

Section 8. Visitation.

Officers, agents, representatives or members of the Union who are not employees shall be admitted to Library premises for the purpose of conferring with an employee who has a grievance, investigating the grievance and representing an employee at a formal grievance hearing. Arrangements of such appearances shall be made in advance through the office of one of the following appropriate supervisors: Director for Human Resources or Deputy Director, and such visits shall be limited to those portions of the said premises designated for this purpose.

Section 9. Stewards.

(A) The Library recognizes the right of the Union to designate shop stewards. The function of the shop steward shall be to assist Union members in the presentation of grievances. The performance of this function shall in no way interrupt the Library's normal operations of the Library. The Union shall notify the Library of the work locations under the jurisdiction of each shop steward. Each shop steward will be permitted, if necessary, to spend no more than two hours per employee per year, for each employee in the bargaining unit under his or her jurisdiction, provided that no shop steward shall spend more than a maximum of four hours of working time in any one week, in the investigation and presentation of grievances.

(B) Shop stewards, Union officers and members of any committee referred to in this Agreement shall inform their immediate supervisors, in advance, of the date, time and place of any meeting or other Union activity specifically permitted under the express terms of this Agreement, the amount of time expected to be consumed thereby and how such steward, officer or committee member may be reached during such period. If such steward, officer or committee member is himself/herself a supervisor he/she shall also provide the same information to his/her immediate subordinate.

(C) The Union President of the Queens Borough Library Guild, Local 1321, ATSCME, AFL-CIO (hereafter "Local 1321"), when acting on matters related only to the interests of the employees covered by this Agreement, shall be permitted full released time to perform the duties of such office and to attend to such matters, without diminution or loss of pay or other employee benefits. The office of the said Union President shall be placed in a space provided by the Library at a location mutually acceptable to the Library and the Union, and shall receive all mail, telephone calls and messages and other correspondence at such location. The Union President shall inform the office of the Director of the presence or absence of such Union President.

Section 10. Time Spent at Negotiations.

The Library shall permit no more than seven (7) employees on scheduled time, and no more than one employee from each of the Librarian, Clerical and Custodial classifications from any one agency, at any one time, to participate in collective bargaining negotiations. One (1) such employee shall be the President of Local 1321. Employees must receive advance approval for participation at such negotiations. Except as may be provided elsewhere in this Agreement, no other Union activity shall be conducted on Library time.

Section 11. Union Conventions and Conferences.

The Library shall permit no more than four (4) employee representatives to take leave without pay or leave chargeable to such employees' annual leave balances, to attend general Union conventions and conferences. Such leave time must be approved in advance by the Library. The Library will also consider requests from other members of the Union for annual leave for these purposes.
